These Terms of Service ("Terms") govern your use of ToolboxPrep (the "Service"), operated by ToolboxPrep ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
01What ToolboxPrep is
ToolboxPrep is an independent online study site with practice questions and timed practice tests for the ASE certification tests. It is run by Trevor Mulder, a small business based in Alberta, Canada. ToolboxPrep is not affiliated with or endorsed by ASE (the National Institute for Automotive Service Excellence). "ASE" and the names and codes of the ASE tests (such as "A5 Brakes") are used only to describe which test our material helps you study for. They are ASE's marks, and we never use the ASE logo.
02Study aid only, no guarantee of a result
Our questions are original practice questions written to the published ASE test specifications and task lists. They are not actual ASE test questions, and we do not sell, copy or reproduce real test content. Using ToolboxPrep does not guarantee that you will pass any test. Our content is a study aid, not professional, legal, safety or repair advice: always follow the vehicle manufacturer's service information, your shop's procedures and the law where you work. We work to keep the content accurate, but it may contain errors.
Our pass guarantee is an extension of access if you don't pass, not a promise that you will.
03Your account
You must be at least 16 and able to form a binding contract to use the Service. Keep your account information accurate and your password private; you are responsible for activity under your account. Accounts are for one person: do not share your login. Tell us promptly at support@toolboxprep.com if you think someone else has used your account.
04Acceptable use
You agree not to:
- copy, scrape, republish, resell or redistribute our questions, explanations or other content;
- share, sell or transfer your account or access to paid content;
- access the Service or its data other than through the interface we provide, or interfere with or disrupt it;
- use the Service or its content to build or train a competing product or dataset.
05Intellectual property
The content of the Service, including questions, answer explanations, text, design and software, belongs to ToolboxPrep or its licensors and is protected by law. We give you a limited, personal, non-transferable, revocable license to use it for your own test preparation. All other rights are reserved. Trademarks mentioned on the Service, including ASE, belong to their owners.
06Purchases, pricing and access
Some features need a paid plan. Prices are in US dollars, are one-time payments (not subscriptions), and may change; the price shown when you buy is the price you pay. A Test Pass unlocks one ASE test and All Tests unlocks every test we offer, each for the period shown on the pricing page and at checkout (120 days from the date of purchase). Payments are processed by Stripe; we never receive or store your full card number. Your bank may add its own fees, for example for a purchase from a business outside the United States. You are responsible for any taxes that apply, unless we say otherwise at checkout.
07Refunds and the pass guarantee
Refunds, the 7-day money-back guarantee and the pass guarantee are covered by our Refund Policy, which forms part of these Terms.
08Disclaimers
The Service and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that the content is complete or current.
09Limitation of liability
To the fullest extent the law allows, ToolboxPrep and its operator will not be liable for indirect, incidental, special, consequential or exemplary damages, or for lost profits, data or goodwill, arising from your use of (or inability to use) the Service, including any test result. Our total liability for any claim about the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.
Some states do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these Terms limits any right you have under consumer protection law that cannot be waived by contract.
10Termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or use the Service in a way that could cause harm or legal exposure. Sections that by their nature should survive termination (including intellectual property, disclaimers and limitation of liability) survive.
11Changes to these Terms or the Service
We may update these Terms or the Service from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, tell you by email or on the site. Using the Service after changes take effect means you accept the updated Terms.
12Governing law
ToolboxPrep is a Canadian business, run from Alberta. These Terms are governed by the laws of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-laws rules, and the courts of Alberta, Canada have jurisdiction over any dispute. This does not take away any protection you have under the mandatory consumer protection laws of the state where you live.
